Marriage is Marriage and so is Divorce

Capps Law Firm is at the Forefront of LGBT Family Law

On June 26th, 2015, the United States Supreme Court ruled that states cannot prevent same-sex couples from marrying. This ruling legalized LGBT marriage in all 50 states. The Supreme Court decision was a substantial step forward for equal marital rights in the US.

While the Supreme Court ruling that LGBT marriage is legal stands as the law of the land, states are still working out some of the finer details. These details can be particularly sensitive in the area of parental rights and second parent adoption. This is due to claims that LGBT parentage effects the well-being of the child.

However, numerous studies have shown that children of LGBT parents are just as healthy and well-adjusted as children of heterosexual parents. These studies have proven that good parenting is not determined by the sexual orientation of the parents, anyone can be a great parent with caring, love, and good parenting skills. Still, the legal rights of LGBT parents vary significantly across states.

Same-Sex Divorce is Just Divorce

Today, same-sex couples have the same right to divorce as traditional couples seeking a divorce in the US. Just as Marriage is Marriage, so is divorce. Prior to Obergefell v. Hodges, same-sex couples had difficulty getting divorced because not all states recognized their marriage. Some couples would go to a state where same-sex marriage was legal, then move to another state where it was not. This prevented them from divorcing.
